Terms of Sale
PRICING
All prices provided are guaranteed for 30 days from the date of written quote, unless otherwise noted. Unless noted, prices do not include applicable taxes or freight costs. Prices are subject to change without notice. Customer is responsible for payment of all applicable state and local taxes, or for providing a valid sales tax exemption certificate. When placing an order, customer shall indicate which products are tax exempt. Munro Supply, Inc. reserves the right to reject any order.
DEPOSITS
We reserve the right to require a deposit on the total invoice amount for any order. The amount of deposit will be at Munro Supply Inc.’s discretion. Munro Supply, Inc. will notify customer of deposit requirement at time of order.
PAYMENT TERMS
We accept cash, checks, money orders, direct deposit, Visa, MasterCard, Discover and American Express. Credit card payments made on the date of invoice or within 10 business days of invoice date will not incurr a fee. Credit card payments made 11 or more business days after the date of invoice will incur a 3% service charge. For customers with established credit, terms are net, due 30 days following the date of invoice. A finance charge is computed on a periodic rate of 2% per month, which is an annual rate of 24%, on any previous balance not paid within 30 days (minimum service charge of 50¢). Customer agrees to pay all costs of collection and all attorney’s fees if the account becomes delinquent and is referred for collection.
FREIGHT & SHIPPING
Freight terms are FOB Munro Supply, Inc. dock, unless otherwise noted. Unless other arrangements are made, we will ship to an address provided by customer, by the most efficient means we find. Shipping and handling charges will be added to invoices. Separate freight charges may apply if order contains items which ship from multiple suppliers or which are expedited. We are not liable for any delays in shipping or issues related to arrival times and do not guarantee delivery dates.
WARRANTY
There are no warranties, express or implied, made by Munro Supply, Inc. for any and all products sold by Munro Supply, Inc. The manufacturers’ warranty shall apply and the same is made a part hereof as though fully set forth herein. The manufacturers’ warranty is the only warranty applicable and is expressly in lieu of all other warranties, express or implied, including any express or implied warranty of merchantability or fitness for a particular purpose.
All manufacturers’ standard warranties shall apply but shall in no event exceed repair or replacement at Munro Supply Inc.’s option and/or choice of locations. Munro Supply Inc. shall not be liable for any damages, whether real or implied, for any injury, loss or damage, direct or consequential, for any reason. Maximum liability in all events is limited to and shall not exceed the purchase price paid.
RETURN POLICY
All claims and returns must be accompanied by the proper invoice.
1. 30-days, new condition – We will provide a full refund for all stock items returned in new condition within 30 days of purchase with proof of purchase.
2. Special orders and custom hose orders – We will work with manufacturers to facilitate any possible return for special order items. These items often carry restocking charges and may not be eligible for return. All special order cancellations must be approved and may be denied or subject to restocking fees and other charges.
3. Damaged in shipping – Great care is taken in filling, checking and packing your order. Should your order be damaged or lost in transit, write so on the delivery receipt before signing. If a truck shipment is damaged, please obtain an inspection report from the truck line immediately. Munro Supply Inc. will help to resolve the situation to the best of our ability.
4. Damaged, defective, or unfit for use, returned within manufacturer’s warranty period – We will work with manufacturer to facilitate return, refund or replacement for any items that are found to be damaged, defective, or unfit for use. We will expedite these issues to the best of our ability.
PRODUCT COMPLIANCE AND SUITABILITY
Munro Supply, Inc. does not guarantee compliance or suitability of the products it sells with any laws, codes or regulations. Munro Supply Inc. does not accept responsibility for construction, installation and/or use of a product. It is the customer's responsibility to review the product application and all applicable laws, codes and regulations for each relevant jurisdiction to be sure that the construction, installation, and/or use involving the products are compliant.
Customer will be solely responsible for all care, maintenance, storage, installation and operation of equipment purchased from Munro Supply, Inc, and bear the entire risk of loss, theft, destruction or damage. Customer is solely responsible for determining whether the products purchased will be sufficient to provide performance required to complete the functions desired, including but not limited to pressure performance and suitability, durability, and longevity.
ENTIRE AGREEMENT
No employee or agent of Munro Supply, Inc. has been authorized to make any promises, representations or warranties binding Munro Supply Inc., or its parent company, Munro Companies, Inc., or its owners or management, other than those contained here or those which have been reduced to writing and signed by an officer of Eclectic Industries, Inc. Any verbal or written statements made by an employee or agent which are contrary to the provisions of this paragraph shall be deemed mere expressions of opinion and not binding. This Agreement constitutes the entire agreement between Munro Supply, Inc. and the Customer with respect to the purchase of equipment, superseding all other agreements, whether oral or written.
